Spott — Terms of Service
Effective: 2026-06-10
These Terms of Service ("Terms") form a binding agreement between you and a solo developer ("we", "us", "the operator"), the operator of Spott (the "app", "service"). Reading them is part of being on the app. If you don't agree to these Terms, don't use the app.

Quick summary (not legally binding — section 1 onward is): 18+ only. Be respectful. No nudity, no harassment, no spam, no impersonation, no commercial sex work. We can suspend accounts for breaking the rules. You own your photos and content. We charge for Spott+ (cancel any time via Apple). Disputes go to Oklahoma courts.
1. Eligibility
You must be 18 years of age or older to use Spott. You must have the legal capacity to enter into a binding contract under the laws of your jurisdiction. By creating an account you represent that this is true.
If we learn you are under 18 we will permanently terminate your account and delete your data, including any uploaded verification selfie, immediately.
Spott is not available in jurisdictions where its use would be unlawful.
2. Your account
You agree to:
- Provide accurate sign-up information (email + date of birth).
- Keep your password secret.
- Use one account per real person. No impersonation, no shared accounts.
- Be responsible for all activity under your account.
- Notify us at spottnowapp@gmail.com if you suspect your account has been accessed without your permission.
We reserve the right to suspend or terminate accounts for any reason including, but not limited to: violation of these Terms, harassment of other users, evasion of bans, use of automated tools (bots, scrapers), repeated reports from other users, or upon receipt of a credible legal demand.
3. Acceptable use
You agree NOT to:
- Harass, threaten, stalk, dox, sexually harass, or sexually exploit any user.
- Post nudity or sexually explicit content anywhere on the public profile. (Bare chest is fine. Genitalia, exposed nipples in a sexual context, and explicit acts are not.)
- Post or distribute child sexual abuse material (CSAM) or any content depicting minors in sexual context. This is grounds for immediate termination and a report to the National Center for Missing & Exploited Children (NCMEC) and applicable law enforcement.
- Post content that promotes illegal activity, terrorism, violence, hate against protected groups, or self-harm.
- Solicit, advertise, transact, or facilitate sex work or escort services through the app.
- Solicit money, gifts, cryptocurrency, or anything of value from other users (romance scams).
- Spam, phish, distribute malware, or send unsolicited bulk messages.
- Impersonate another real person, public figure, or account.
- Scrape, mirror, index, or otherwise mass-extract data from the app.
- Reverse-engineer, decompile, disassemble, or attempt to circumvent the app's technical protections (verification, rate limits, content moderation, screenshot detection).
- Upload malware, viruses, or any harmful code.
- Use the app to violate any applicable law or regulation.
We use a combination of automated content moderation (Google Cloud Vision SafeSearch on public-facing photos — profile, casual, and Looking Now images) and human review. Private photos, including private albums and photos sent in chat, are not automatically scanned and are reviewed only if a user reports them. We may remove content, suspend, or permanently ban accounts that violate these Terms — with or without prior notice.
Private albums + screenshot detection
Private albums allow you to share photos with specific matches. Screenshotting another user's private album content may violate their privacy and may be unlawful in your jurisdiction (image-based abuse / "revenge porn" laws). If you are a Spott+ subscriber, screenshots trigger automatic revocation of the recipient's access. We may suspend accounts that repeatedly screenshot album content shared with them.
4. Content you post
You retain ownership of the photos, voice intros, and messages you post.
You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, transmit, reproduce, and back up your content for the limited purpose of operating, securing, and improving the app. This license ends when you delete the content or your account, except for log-level safety records (block, report, and ban entries) retained for up to 12 months.
You confirm that:
- You have the legal right to post any content you upload.
- The content does not infringe a third party's copyright, trademark, privacy, or publicity rights.
- You consent to any other identifiable people appearing in the content.
We do not use your content to train AI/ML models. We do not sell, license, or share your content with advertisers.
DMCA / copyright complaints
If you believe content on Spott infringes your copyright, send a notice with the elements required by 17 U.S.C. § 512(c)(3) to spottnowapp@gmail.com with subject line "DMCA Notice". We will investigate and remove infringing content where appropriate. Repeat infringers will have their accounts terminated.
5. Verification + DMs
Direct messages only open between two verified profiles. Verification is done manually by reviewing a selfie you upload. Approval is at our sole discretion. We may revoke verification at any time if we have reason to believe a profile is fraudulent, impersonates another person, or violates these Terms.
Your verification selfie is treated as biometric data under applicable privacy law. See our Privacy Policy for retention, access controls, and your rights regarding biometric data.
6. Reporting + safety
If you encounter a profile or message that violates these Terms:
- Use Block to immediately prevent that user from contacting you or seeing your profile.
- Use Report to flag the violation for our review. We typically review and act within 24 hours.
For immediate safety threats, contact local law enforcement first, then us.
Emergency disclosures: We may disclose user information without notice when we believe in good faith that doing so is necessary to prevent imminent physical harm.
7. Subscriptions, in-app purchases, and Spott+
The Spott app is free to use for the core experience: making a profile, browsing, matching, sending messages between verified profiles. Some features require payment:
Subscriptions
- Spott+ Monthly — $5.99/month, auto-renewing.
- Spott+ Annual — $49.99/year, auto-renewing.
- Founding Member — $2.99/month, auto-renewing, limited to the first 1,000 subscribers.
Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before the period ends. Manage your subscription in your iOS device settings → Apple ID → Subscriptions. Apple, not Spott, processes the payment and handles cancellations under the Apple Media Services Terms and Conditions.
Founding Member offer — specific terms
- Available only to the first 1,000 subscribers who select the Founding Member tier.
- Eligibility requires being on the Spott waitlist at the time of subscription.
- The $2.99/mo rate is locked in for as long as the subscription remains continuously active. If you cancel or your subscription lapses for any reason (failed payment, refund, expiry without renewal), the Founding Member tier is forfeited and cannot be reinstated.
- Founding Members receive every Spott+ feature plus a "Founding Member" badge visible on their profile.
- We reserve the right to modify the Founding Member benefits only in your favor (e.g., add more features) — we will not retroactively reduce them.
- The 1,000-spot cap is firm. Once filled, the Founding Member tier closes permanently and no further enrollments are accepted, regardless of subsequent cancellations.
Consumable in-app purchases
- Boosts ($1.99 single, $7.99 5-pack, $24.99 20-pack) — 30-minute floats to the top in your area.
- Looking Now passes ($2.99 per post) — one 1-hour high-intent post.
Consumables are non-refundable once used, except where required by law.
Refunds and EEA / UK consumer rights
All payments are processed by Apple. Refunds are handled under Apple's policy at reportaproblem.apple.com. We cannot issue refunds directly.
If you are a consumer in the European Economic Area, United Kingdom, or Switzerland, you have a statutory right to withdraw from a purchase within 14 days unless you have begun consuming the digital content/service (which happens immediately upon subscription activation or boost/Looking Now use). By initiating the purchase, you expressly consent to immediate provision of the digital service and acknowledge that this waives your 14-day withdrawal right under EU Directive 2011/83/EU.
Price changes
For auto-renewing subscriptions (other than the Founding Member tier), we may change the price with at least 30 days' notice via in-app message and email. Continued use after the new price takes effect is your acceptance. Founding Member pricing is exempt from price increases as long as the subscription stays continuously active.
Free trials
We do not currently offer free trials. If we add them, the trial-to-paid conversion terms will be disclosed in the purchase sheet before you confirm.
8. Privacy
Your use of the app is also governed by our Privacy Policy. The Privacy Policy explains what we collect, why, who we share it with, and the rights you have over your data.
9. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
- The app will be uninterrupted, error-free, or secure.
- Verification, photo moderation, or safety features will detect every bad actor or piece of harmful content.
- Other users are who they say they are.
We do not background-check, screen, or monitor users offline. You are solely responsible for your interactions with other users, including meeting in person. Recommended: meet in public the first few times. Tell a friend where you'll be. Trust your instincts.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, or substitute services, arising out of or related to your use of the app — even if we have been advised of the possibility of such damages.
- Our total cumulative liability for any claim arising from these Terms or the app is limited to the greater of (a) USD $100 or (b) the amount you paid us in the 12 months preceding the event giving rise to the claim.
Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permissible by law. Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify, defend, and hold us harmless from any claim, demand, loss, liability, damage, or expense (including reasonable legal fees) arising from (a) your use of the app, (b) your violation of these Terms, (c) your violation of any third party's right (including privacy, publicity, intellectual property), or (d) any content you post.
12. Termination
We may suspend or terminate your account at any time for any reason or no reason, with or without notice. You may delete your account at any time via Settings → Account → Delete account.
Upon termination, your right to use the app ends immediately. The following sections survive termination: Section 4 (license to your content for the period it remains in our backups), Section 8 (privacy), Section 9 (disclaimer), Section 10 (limitation of liability), Section 11 (indemnification), Section 14 (governing law).
If you are a paying Spott+ subscriber whose account is terminated by us without cause and not for violation of these Terms, we will refund the unused portion of your current billing period.
13. Apple-specific terms
For users on iOS, in addition to these Terms, the Apple Media Services Terms and Conditions apply (apple.com/legal/internet-services/itunes).
You acknowledge that:
- These Terms are between you and the operator, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- In the event of any failure of the app to conform to applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any).
- Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
14. Governing law and disputes
These Terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict-of-laws principles.
Any dispute arising from or relating to these Terms or the app will be brought exclusively in the state or federal courts located in Cleveland County, Oklahoma, and you consent to the personal jurisdiction of those courts. The U.N. Convention on the International Sale of Goods does not apply.
Small claims carve-out
Notwithstanding the above, either party may bring a qualifying individual claim in small claims court in the claimant's home jurisdiction.
Class-action waiver
You and we agree that disputes must be brought on an individual basis, not as a plaintiff or class member in any purported class, consolidated, or representative action. If a class-action waiver is unenforceable in your jurisdiction, this section does not apply to you, and the dispute may proceed under the otherwise-applicable forum.
Consumer protection
Nothing in these Terms waives any non-waivable consumer rights you have under the law of your country of residence.
15. Changes to these Terms
We may update these Terms periodically. Material changes will be announced in-app at least 30 days before they take effect, and where required by law, we will request your renewed acceptance. Non-material changes (clarifications, typo fixes) take effect when posted with an updated Effective date.
If you don't agree to a material change, your remedy is to stop using the app and delete your account before the change takes effect.
16. Miscellaneous
- Entire agreement: these Terms, together with the Privacy Policy and any subscription-specific terms, are the entire agreement between you and us regarding the app.
- Severability: if any provision is unenforceable, the remaining provisions stay in effect.
- No waiver: our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment: you may not assign these Terms; we may, including in connection with a corporate transaction, with notice to you.
- No agency: nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
